I think this EULA is crazy, SDG has gone full big corporation and is completely turning their back on what used to make them a much loved company. Shame on you
Well, seems quite reasonable so they don’t have any problems in future.
what is so insane about it? It looks like any other EULA. (yes I did read it)
Seems like basic protections and whatnot, you’re gonna have to give real quotes and proper breakdowns to make these claims.
The Unturned EULA is quite similar to Steam’s own agreement(s). The primary factor driving it is the open sourcing of the game, which will occur soon™. The game also had a buried original EULA from years ago that sat unused, as there wasn’t need for one.
EULAs are common practice but that doesn’t mean they can’t go too far, my main concerns with this EULA in particular are:
-
Incredibly broad indemnification clauses:
Anyone who subscribes to the EULA is indemnifying SDG for just about everything, this also includes issues outside of their control, for example:
“…even if such action or inaction of SDG Group amounts to gross negligence, intentional act or willful misconduct.”
This is questionable because they’re essentially asking players to protect them even if they are at fault. -
Extreme liability clause:
SDG fully disclaims all warranties and limits liability to half the revenue received in the last 6 months
“…Subscriber hereby releases SDG Group of all liability… even if… gross negligence, intentional act or willful misconduct.”
This is already a pretty big shield they’ve put up but compare it to Clause 12 which states:
“The Subscriber will be fully liable to the SDG Group and release, indemnify, defend and hold harmless the SDG Group from and against claims…”
SDG didn’t set any monetary cap on how much a user might have to pay if SDG suffers losses due to a user’s actions. This means that SDG can sue anyone who breaches the EULA for any amount of money they wish whereas subscribers of the EULA are capped at a certain amount even if SDG admits to gross negligence. -
Very One-Sided IP and terms regarding suggesting features
If users create content or post suggestions, SDG can use them in perpetuity, royalty free, and the user gets nothing unless explicitly agreed otherwise. I don’t think I even need to mention how predatory this seems. Here’s an example: if you posted a mod on the steam workshop, and you had signed the EULA, SDG can take that entire mod and add it to their game and not need to pay you anything for it.
The entire EULA leans heavily in favour of the company, it’s a totally corporate minded EULA, which is such a change of face from what Unturned has always been presented as. SDG has made many statements regarding how they view Unturned as more of a “hobby” and a “community driven” game, but this new EULA contradicts that in its entirety, a lot of the terms in this EULA are shaky and anti consumer. I feel it is also incredibly dense and hard to make sense of, especially when it has players giving up a lot of control, it just seems unethical and strange. Again, I’m not suggesting that SDG not have a EULA, but the one SDG is proposing could benefit greatly from clearer limits on user liability, as well as a fairer approach to modders.
@WitnessProtection Thank you for an actual breakdown. I was thinkin’ it seemed too broad to their favor, and yeah it falls under the whole “Well they won’t abuse it like that” excuse while they technically can abuse it if they wanted to.
Very wierd and possibly a self-callout that they are preparing this heavily in their favor for protection/immunity. I get how some creators might want their stuff added to the game as features and might not care about getting revenue, but that should be agreed upon by both sides privately and such immunity wouldn’t be needed if a fair deal was made.
Thanks Witness, definitely appreciate seeing someone post some constructive comments in relation to this.
I definitely agree about some of your points. However, there is a lot of irony to the whole corporate fashion. Especially considering some people called for selling the game, which would have crushed the whole hobbyist part.
