I am no expert, but that TF2 image doesn’t seem to meet this requirement:

“the former price is the…price at which the article was offered to the public on a regular basis for a reasonably substantial period of time”

So it appears to me that it does violate §233.1 Former price comparisons., however Valve has lots of lawyers, likely they are in line with the FTC through some other capacity that I am not aware of.

Edit: This might not violate the law, because TF2 is Free. Meaning you can’t scam someone out of $0. The consumer is unable to be damaged.

There have been a lot of times where I’m looking at computer parts online and people give insane markups to components and then “discount” them to where they are the same price as something that isn’t even on sale.

I’ve actually seen that on Media Markt, they had a tag saying something like “3,99€ 2,99€” but forgot to take off the older, full-price tag that stated 2,99€. Shame
